Terms and conditions
This is an English translation of the Dutch original. If the two versions differ, the version that is more favourable to you as a consumer applies.
Version 1.0, effective from 10 October 2026. English translation of the Dutch original.
Article 1 — Who we are and how to reach us
- WatKomtEr (watkomter.nl), located at Buitenstad 31, 4132 AA Vianen, the Netherlands, registered in the Trade Register of the Netherlands Chamber of Commerce (KvK) under number 84887478, VAT identification number NL004039723B09. In these terms, WatKomtEr is referred to as “we” or “us”.
- You can reach us by email at info@watkomter.nl. Our company details and how to reach us are on Contact and company details.
- We are not affiliated with a disputes committee or a code of conduct.
Article 2 — Definitions
- Koopcheck: the digital report in PDF that we compile automatically, at your order, for one address or location in the Netherlands chosen by you (see article 3).
- Consumer: a natural person who is not acting in the course of a profession or business.
- Contract: the distance contract between you and us for the delivery of one Koopcheck.
- Sources: the public, official data sources we consult for the Koopcheck (see article 3(2)).
- Durable medium: a means that lets you store information and read it back later unchanged, such as an email.
Article 3 — What the Koopcheck is
- The Koopcheck is digital content not supplied on a tangible medium: a personal report in PDF about one address or location in the Netherlands. The report is a dated snapshot of developments within a radius of 1 kilometre around that address.
- At the time of ordering, the report is compiled from: official notices from municipalities, provinces and water boards (KOOP / Overheid.nl) from the 18 months before the report date; zoning plans (Informatiehuis Ruimte via the Digital System for the Environment and Planning Act) with a plan status from the 18 months before the report date; and current and planned roadworks (National Road Traffic Data Portal, NDW). These sources are in Dutch.
- For each development, the report contains: what the source says (with a link to the official publication), our plain-language translation, our assessment of what the development may mean for the address, an indicative impact score from 1 to 5, the distance and direction from the address, the status and the expected period as far as the source provides it, and what is still uncertain. It also contains a summary, a map, an overview of the sources consulted with the date they were consulted, and an explanation of the limitations. If you order in English, everything we write ourselves is in English; official titles and quotes from the sources stay in Dutch.
- You read the report with a standard PDF reader (for example in your browser or on your phone). There are no further technical requirements.
- We currently offer no subscriptions. As long as no subscription can be ordered on watkomter.nl, the Koopcheck is our only product.
Article 4 — Price
- The price of the Koopcheck is €9.95 including 21% VAT, one-off, per address. There are no additional costs.
- The total price is shown before ordering in the order block and on the order button.
Article 5 — Ordering, payment and conclusion of the contract
- You order a Koopcheck on watkomter.nl by choosing an address, viewing the radar, entering your email address in the order block, agreeing to these terms, expressly consenting to immediate delivery (article 7(3)) and clicking the button “Order and pay · €9.95” (in Dutch: “Bestellen en betalen · € 9,95”). That button makes clear that your order involves an obligation to pay.
- You are then redirected to the secure payment page of our payment service provider Mollie B.V. There you pay with one of the payment methods offered (currently iDEAL). From Mollie we only receive a payment reference, the amount and the payment status; we do not see your bank details.
- The contract is concluded when Mollie confirms to us that your payment has succeeded. If you cancel the payment, if it fails or if the payment page expires, there is no contract and nothing is charged.
- Immediately after the confirmed payment, before delivery, you receive an email from us confirming the contract: order number, product, price, these terms (with version number) and confirmation of your consent to immediate delivery. Please keep this email.
- You order without an account. Your order number (WKE-XXXXXXXX) and the email address you used when ordering are together the key to your order, your confirmation page and the withdrawal function.
- We only supply the Koopcheck for addresses and locations in the Netherlands. If you live in another country of the European Union, you keep the mandatory consumer protection of that country.
Article 6 — Delivery
- As soon as your payment is confirmed, our system automatically creates the report using the sources in article 3. The report is delivered as soon as it is available to you: as a PDF attachment to our email and via the download link on your confirmation page. In most cases this is within a few minutes of payment.
- The download link works for 30 days after delivery. Please keep the report yourself. After 90 days we delete the report (see article 12).
- If a source is temporarily unavailable, our system automatically tries delivery again and we email you about it. If we cannot deliver the report within 24 hours of your payment, we will refund the full purchase price within 14 days via the same payment method. You do not need to do anything; you will receive a confirmation by email.
- If one of the sources is unavailable while the report is being created, the report states this clearly, naming the missing source. In that case article 9(4) applies.
Article 7 — Cooling-off period and right of withdrawal
- With a distance contract, as a consumer you have a statutory cooling-off period of 14 days, counted from the day the contract is concluded (article 5(3)). Within that period you can terminate the contract without giving reasons (“withdraw”).
- For digital content not supplied on a tangible medium, such as the Koopcheck, a statutory exception applies (article 6:230p(g) of the Dutch Civil Code): the right of withdrawal lapses as soon as delivery has begun, but only if you (a) expressly consented in advance to delivery during the cooling-off period, (b) declared that you thereby give up your right of withdrawal, and (c) received confirmation of this from us on a durable medium.
- That is why, when you order, we ask for this consent and declaration with a separate tick box: “I agree to the terms and conditions and expressly request immediate delivery of the report (digital content) during the cooling-off period. I declare that I thereby give up my right of withdrawal once delivery has begun.” You cannot order without ticking it. We record the time of your consent and the version of these terms with your order and confirm the consent in the email referred to in article 5(4), before delivery begins.
- As a result: as long as the report has not been delivered, you can withdraw from the contract free of charge. Once the report has been delivered, your right of withdrawal has lapsed. If something is wrong with the report, your rights under article 9 apply.
- If, for whatever reason, you did not (validly) consent to immediate delivery, or you did not receive the confirmation referred to in article 5(4), your 14-day cooling-off period simply continues to apply and you owe nothing if you withdraw.
- You can withdraw via the online withdrawal function at watkomter.nl/herroepen/ (you enter your order number and email address, confirm the withdrawal and immediately receive an acknowledgement by email with the content of your notice and the date and time it was submitted), by email to info@watkomter.nl stating your order number, or with the model form in the annex. You do not need to create an account. The withdrawal function is available throughout the cooling-off period.
- After a valid withdrawal, we will refund all amounts you have paid without undue delay and no later than 14 days after receiving your withdrawal, via the same payment method and at no cost to you.
Article 8 — What the report is and is not
- The report is a snapshot of the sources on the report date on the cover page. Sources are updated daily; publications after that date are not included.
- The sources are not complete. Not every development is officially published or included in the sources used. Plans that only exist in other systems, private initiatives not yet applied for and verbal agreements are not visible. The report is therefore no guarantee that all future developments around the address have been found.
- Not all publications have a precise location. The distance in the report is measured to the point, line or area the source gives. For a decision covering a large area, “at the address” says little about your own street; the report states this.
- In the report we always distinguish between fact and assessment: “what the source says” is quoted or compiled from the source; “in plain language” is our translation; “what does this mean for you?” and the impact score are assessments based on fixed rules (size, distance, disruption). Assessments are not facts and not a prediction.
- The plans source states that the dataset may contain test content. If in doubt, check the plan itself via the source link in the report.
- The report is not legal, structural or financial advice and not a valuation. It does not replace research by an estate agent, notary, lawyer or the municipality and does not automatically fulfil your own duty to investigate when buying a home.
- We do not guarantee any particular outcome, such as whether or not a development goes ahead.
Article 9 — If the report is not in order: your statutory rights
- The report must conform to the contract (Title 1AA of Book 7 of the Dutch Civil Code). Among other things, this means that it contains the content described in article 3, is legible and complete, and was made with the sources and reference date stated in it.
- If the report does not conform to the contract, you are entitled to free repair within a reasonable period (for example by recreating the report or making it available again). If repair is impossible, fails or the defect is serious, you are entitled to a proportionate price reduction or to termination with a full refund, within 14 days of telling us your choice, via the same payment method and at no cost.
- If we do not deliver the report, article 6(3) applies; in addition, you can terminate the contract if delivery still does not take place after a reasonable period set by you.
- Incompleteness of the sources themselves (article 8(2)), later changes in the sources and the fact that an assessment turns out differently are not defects in the report. If a source was missing while the report was being created (the report says so), let us know within 14 days of delivery if you do not want to keep the report for that reason; we will then recreate it free of charge as soon as the source is available again, or refund the price, at your choice.
- Nothing in these terms limits the rights you have as a consumer under the law.
Article 10 — Liability
- We make every effort to provide a careful and up-to-date report and are liable for damage resulting from a failure attributable to us, as provided by law.
- We are not liable for damage resulting from inaccuracy or incompleteness of the sources themselves (article 8), as long as we have represented the sources correctly and referred to the official publication. Decisions you make based on the report, such as whether or not to buy a home, are your own responsibility; the report is not advice (article 8(6)).
- To the extent permitted by law, our liability for damage per contract is limited to no more than three times the price of the Koopcheck.
- The limitations in this article do not apply in the event of intent or deliberate recklessness on our part, nor to damage caused by death or personal injury, and they do not affect your statutory rights under article 9 (repair, price reduction, termination and refund).
Article 11 — Use of the report
- The report is intended for your own use. You may freely share it with the people who help you make your decision, such as your partner, family, estate agent, mortgage adviser, notary or lawyer, and use it in your own correspondence about the address.
- You may not resell the report, offer it as your own product or publish it on a large scale (for example in full on a website or in an advertisement). Quoting with acknowledgement of the source is allowed.
- The underlying government data is open data from the source holders named; we place no restriction on it and you can always consult it yourself via the source links. Our rights only concern the compilation, translation, assessments and design of the report.
Article 12 — Privacy and retention periods
- How we handle your email address, the chosen address, the payment, the report and the record of your consent is described in our privacy statement.
- In summary: we automatically delete the report, the data snapshot, the address and the coordinates 90 days after the order. We keep your email address, the record of your consent and the confirmation of the contract for up to 2 years after your payment, so that we can handle complaints, withdrawals and legal claims. We keep the data we must retain for tax purposes (order number, dates, amount, VAT, payment reference and any refund) for 7 years after the end of the financial year, without the address, report or email address.
Article 13 — Complaints and contact
- Do you have a question or complaint about your order or the report? Email us at info@watkomter.nl and mention your order number (not your address). We respond as quickly as possible and do our best to find a solution together.
- Our commitment: you receive an acknowledgement within 2 working days and a full response within 14 days of receipt of your complaint. If we need more time, we will let you know within those 14 days, with the reason and the period within which you can expect a response (no later than 4 weeks after receipt of your complaint). Statutory refund periods (articles 7 and 9) always take precedence.
- We handle complaints by email. You do not need to log in anywhere. You may write to us in Dutch or English.
Article 14 — Applicable law and disputes
- The contract and these terms are governed by Dutch law. If you live in another country of the European Union, you also keep the protection of the mandatory consumer rules of that country.
- If we cannot resolve a dispute together, you can bring it before the competent court in the Netherlands; as a consumer you may also choose the court of your own place of residence, to the extent the law allows. We are not affiliated with a disputes committee.
- You can also report a complaint about our conduct to the Netherlands Authority for Consumers and Markets (consument.acm.nl) and, for privacy complaints, to the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
Article 15 — Changes to these terms
- We may change these terms, for example if the product or the law changes. A change only applies to contracts concluded after the new version has been published.
- Your order is governed by the terms as they appeared on watkomter.nl at the time of ordering; the version number is in your confirmation email and is recorded with your order.
Annex — Model withdrawal form
Only complete and return this form if you wish to withdraw from the contract. You can also use the online withdrawal function, which gives you an immediate acknowledgement.
